By means of a decree given by this Court, on the 26th March 2013, following  a request of Claire Caruana,  it was ordered that Deputy Curators be chosen to represent  the absent Stephen Liam Moran, in the records of the General Application, 150/13 AL, in the names ‘Claire Caruana vs Deputy Curators’ and in the relative and subsequent acts.
 
By means of an Application filed in the Civil Court  (Family Section) in the names Claire Caruana (I.D. 100780M) vs Deputy Curators to represent the absent Stephen Liam Moran (I.D. 312005L) on the 26th March 2013, the applicant Claire Caruana, asked this Honourable Court, so that saving any necessary and opportune declaration:
 
1. To confirm the judgement of this Honourable Court differently presided Application Number 453/07, especially whereby the Court decided the cause by entrusting the care and custody solely in the hands of the applicant without any restriction and condition.
 
2. Declare that the applicant does not need the authorisation of the father for everything that concerns the minor ...omissis..., once the care and custody of the said minor was entrusted exclusively to her without any restriction and condition  and thus every decision concerning the girl can be taken solely by her.
 
3. To order the Director of the Passport Office, the Directorate for Civil Registration, so that a passport be issued without restrictions in the name of the minor ...omissis..., and this without the authorisation of the father once the care and custody of the said minor, is entrusted solely in the hands of the applicant without any restriction, whilst the father is absent from Malta and abandoned his daughter.

By means of a decree given by the First Hall Civil Court, on the 29th April 2013, in the records of the Garnishee Order number 1390/11 and following the note in order to render the Warrant Executive, Ballut Blocks Services Ltd vs F.G.S. Construction Ltd, the following publication was  ordered for the purpose of service of the debtor company, in terms of Article 187(3) et. of Cap. 12.
 
By means of a Note filed in the First Hall Civil Court, Following the Precautionary Garnishee Order number 1390/11, in the names Ballut Blocks Services Limited (C 8360) vs F.G.S. Construction Limited (C 17794) the applicant company Ballut Block Services Limited  (C 8360) respectfully pleaded:
 
On the fifth October 2011, the interpellant asked for the issuing of a Precautionary Garnishee Order, in the names premised against the respondent.
  
This warrant was upheld in favour of the interpellant on the sixth October 2011.
 
Together with the filing of the precautionary garnishee order above mentioned, the interpellant had filed a sworn application against the repondent in terms of article 167(2) of Chapter XII (Sworn Application Number 966/2011).
 
This cause was decided on Thursday 26th April 2012.
 
A copy of this judgement is attached as document ‘A’.
 
Thus in terms of subarticle 838(B) 2 of Cap. XII, this warrant became executive as soon as this judgement was decided on 26th April 2012.
 
Thus the interpellant is filing this note as stipulated in subarticle 838(B) (a) of the same Cap. XII and ask that the effects of the same warrant be extended:
 
1) by the sum due according to the tax  of the cause (hereby attached as Document ‘B’) in the amount of €4,305.35.
 
2) with the sum due according to the taxed bill of the precautionary garnsihee order (hereby attached as document ‘C’) in the amount of €210.29.
 
3. with the sum due for interests from the day of the filing of this warrant and the sworn application added up to the eighteenth of May 2012, (€5,308.75).
 
Thus it is humbly asked that this Honourable Court in terms of subarticle 838(B) (2) (a) of Cap. That this application is being , filed, in terms of the Hague Convention regarding the Civil Aspects of Child Abduction and the Act regarding the Abducation and Custody of Minors, Cap. 410 of the Laws of Malta, in virtue of which the two conventions regarding the civil aspects of international abduction of minors and the recognition and enforcement of the decisions regarding custody in connection with the Regulation Number 2201/2003 of the European Union, of the 27th November 2003, were ratified;
 
That this application, refers to three minors namely ..omissis.. who was born on the 14th February 1999, certificate of birth attached Doc A, ..omissis.. who was born on the 17th February 2011, Birth Certificate Doc. B, and ..omissis. who was born on the 22nd July 2004, birth certificate Doc. C.
 
That the parties came to live in Malta in 2009 and on the 31st October 2012, they confirmed that their habitual residence is Malta and that the community of acquests was established between them by means of a public deed in the records of Notary Dr Pamela Portanier, LL.D.
 
That unexpectedly and without any information and much more acceptance the respondent Megan, left Malta, together with the three minor children, without the father’s consent and went to New Jersey, in America.
 
That this deed constitutes a violation of the Law of the Hague Convention (Convention on the Civil Aspects of International Abducation) since the mother changed the habitual residence of the same minor without the consent of the interpellant, father of the minors.

Thus the applicant respectfully prays this Honourable Court:
 
1. To decide and declare that the removal of the minors ..omissis.. the three siblings Pacetti, by the respondent from Malta to America, was made in violation of the provisions of Cap. 410 of the Laws of Malta and the Hague Convention on the Civil Aspects of International Abducation and thus they are being held in America, illegally and abusively by the respondent;
 
2. To order that the said minor children be returned within a peremptory stipulated period to Malta, namely  the country of their habitual residence;
 
3. To give in the meantime, all those directives in the interest of the said minor  including notice to the authorities concerned, so that the said children be safeguared from being taken illicitly from America to another country, which removal, makes  the return of the minors above mentiobned to their habitual residence namely Malta, much more difficult.
 
4. To take all the necessary provisions so that these orders/directives be executed without delay and within the terms provided by the Convention above mentioned.

By means of a decree given, on the 9th April 2013, by the Civil Court (Family Section) in the records of the Application following the judgement given, on the 1st February 2013,  in the names Mary Grace Attard vs Mario Attard, Sworn Application number 656/03 NC, the following publication was ordered for the purpose of Mary Grace Attard, in terms of Article 187(3) of Cap. 12.
 
By means of an application filed in the Civil Court (Family Section) Writ of Summons Number 656/03 NC, Decided 01/02/2013, Mary Grace Attard vs Mario Attard, the applicant Mario Attard I.D. 361157(M), following the judgement given by this Honourable Court, on the 1st February 2013, respectfully pleaded:
 
In the first place the applicant wishes that a decision be given regarding a matter which in his humble opinion, was left out of the judgement and namely a decision or confirmation that the sum of €10,539.30, deposited in Court, by HSBC Bank Malta plc by means of Schedule 219/11, marked Doc. MGA 2 (Fol 913) is paraphernal and belongs to the defendant and this since it is forthcoming from the inheritance of his mother and belongs only to him.
 
That the dispute regarding this inheritance due to the applicant was brought up during the hearing before the Honourable Court, on the 23rd November 2011 (fol 909).
 
That in accordance with the Court decree, of the 23rd November 2011, the applicant on the 25th May 2012, filed a note (fol 934) whereby he explained that his mother Loreta Attard, died, on the 21st June 2010.
 
In the same note, the applicant explained how his mother Loreta Attard, had with the HSBC Bank Malta plc, a number of accounts which with the death of his mother were closed. Their balances together amount to €139,599.29. One thirteenth was due to the applicant and namely the amount of €10,738.41. All this was deposited with the Bank in virtue of the Schedule mentioned.
 
In the second place the applicant wishes that a clarification be made regarding the maintenance  and children’s allowance recieved by the plaintiff.

In order to avoid any misunderstandings, the applicant feels that there is room that it be cleared that he has to be paid not only the children’s allowance, but also to be refunded the maintenance he paid to his children when these were living with him, to confirm the date with effect from when the refund of maintenance is to be made and a confirmation be made that the amount due is on the basis of the prospect which is to be found a fol. 939 of the process and the plaintiff be ordered to pay to him this amount.
 
In view of the above, the applicant humbly prays this Honourable Court:
 
i) to confirm that the sum of €10,539.30 deposited in Court by HSBC Bank Malta plc by means of schedule 219/11 marked Doc MGA 2 (fol 913) is paraphernal and belongs to the defendant and this since it is forthcoming from his mother’s inheritance and thus belongs to him alone.
 
2) regarding the children’s allowance and maintenance;
 
a) confirm that the defendant is to pay not only the children’s allowance but also refund the maintance he paid to the plaintiff for his children when these lived with him.
 
b) confirm the date with effect from when the refund of maintenance is to be made.
 
c) confirm that the amount due on the basis of the propspect which is found at fol 939 of   the process.
 
d) order the plaintiff to pay to him this amount.

2. Order the Comptroller of Customs to dispose of the said shoes outside the chanels of trade in such a manner as to preclude any damage to the applicant company or order the Comptroller of Customs to destroy the said shoes, in any case without any compensation  and at the expense of the respondents.
 
3. Order that the respondents are to bear all the expenses in connection with the measures ordered in terms of the second and third demands of the applicant company including those of transport of the said shoes,for storage in Malta, before the final destruction of the said shoes.
 
With costs, against the respondents summoned so that a reference to their evidence be made.
